Officials mull seismic tests near Calif nuke plant

(AP) ? Plans to use an array of powerful air canons in an undersea seismic study near a Central California nuclear power plant have federal and state officials juggling concerns over marine life with public safety.

Pacific Gas & Electric Co. wants to use big air guns to emit strong sound waves into a large, near-shore area that includes parts of marine reserves to make three-dimensional maps of fault zones, some of which were discovered in 2008, near its Diablo Canyon nuclear power plant.

But a state study found the project is likely to have "unavoidable adverse effects" on marine life and the environment. Biologists, environmental groups and fishermen have opposed using the high-energy air guns, saying the blasts have potential to harm endangered whales, California sea otters and other creatures frequenting these waters.

"I am very concerned about impacts to marine mammals, especially some of the large whales including blue, fin, and humpback whales," said John Calambokidis, an Olympia, Wash.-based marine biologist who has studied Pacific Ocean whales for decades. "There are many uncertainties on the impact of this type of operation on whales, especially since we have not seen this type of large air gun survey off California for a long time."

The $64 million, ratepayer-funded effort to understand seismic threats to the plant has intensified since the disastrous 2011 Tohoku quake and tsunami, which disabled reactors at Japan's Fukushima Dai-ichi nuclear power plant. Quake experts were surprised by the 9.0-magnitude quake on a fault that scientists did not believe would produce a quake stronger than 8.0.

Although the Japan disaster demonstrated that predicting the strength of a quake on a given fault is an inexact science, PG&E wants to know if the newly discovered faults near San Luis Obispo are connected to existing ones that have already been studied. Seismologists typically use a fault's length to estimate the maximum possible earthquake it can produce.

"People need to understand, we're living in the world post-Fukushima, so we need to go back and review everything we think we know about the seismic threat situation around important structures like this power plant," said Bruce Gibson, a former seismologist who now serves as a San Luis Obispo County supervisor.

"Unfortunately, from an environmental impact standpoint, the only real way to get the images is to put high energy sound into the earth."

If the project gains approval from myriad agencies, scientists would tow up to 18 air guns behind a boat and blast loud sound into the water over a 530-square-nautical-mile area. Hundreds of sensors would be placed strategically on the seafloor, picking up the reverberations and allowing computers to create three-dimensional maps in technology similar to an ultrasound.

The air guns and sensors would be dragged through an area that includes two state marine protected areas ? Cambria and White Rock ? and is adjacent to the Monterey Bay National Marine Sanctuary. Dozens of endangered and threatened species use these waters.

A similar seismic survey is being planned near the state's other operating nuclear plant at San Onofre, in San Diego County to the south.

A State Lands Commission environmental impact study found on Aug. 20 there would be "unavoidable impacts" to marine life in the area during the San Luis Obispo testing.

But the commission also concluded the "benefit of the project outweighs the unavoidable adverse impacts," said Jennifer DeLeon, a senior environmental scientist at the commission.

While similar high energy seismic surveys have been done on the Pacific Coast ? most recently off Washington ? PG&E said monitors there did not observe harm to whales or other marine mammals.

The powerful canons used in these projects can be fatal to animals that stray too close to them. Also, biologists said the loud noises could drive migrating whales and their calves apart, and that mortally wounded whales often sink in the ocean, so it is difficult to see how the tests affect the creatures.

Efforts to mitigate such impacts will reduce, but not eliminate, harm to animals, according to the company and earth scientists.

"The sound source for the PG&E imaging project is a type that has been used for several decades by scientists and industry," Donna Blackman, a geophysicist at Scripps Institution of Oceanography in San Diego, said in an email. "Known cases of possible impacts on marine mammals are very few. An integral part of using this type of system is to have continuous monitoring for whales within close range of the ship."

PG&E said it is spending $8 million on monitoring for the project, said Mark Krausse, a PG&E director.

"If the ship is coming within 1.1 mile of any mammal, not just a marine or listed, but any mammal, we have to shut down," Krausse told the California Fish and Game Commission on Monday.

PG&E wanted to start work Nov. 1 and continue through Dec. 31 ? a time window believed to have lower whale traffic off the Central Coast. But the company has asked for an extension of its hearing before the California Coastal Commission, and other agencies are not expected to approve testing permits by then.

Major environmental groups such as the Sierra Club and Natural Resources Defense Council oppose the plan, saying adequate seismic research already has been done, and that too little is understood about potential long-term impacts of the air guns on the marine environment.

"The marine protected areas were created (so) marine wildlife could thrive without human interference," said Amanda Wallner of Sierra Club California. "We share concern over earthquake risk at Diablo Canyon. However, we don't believe this is the best way or the only way to determine seismic risks."

Thousands of Poles protest pro-market reforms

(AP) ? Thousands of Poles blew horns, prayed and waved flags in downtown Warsaw on Saturday to show their anger over a new law that raises the retirement age and a host of other issues.

The protest was organized by the conservative and nationalistic opposition party Law and Justice, led by Jaroslaw Kaczynski, as well as the Solidarity trade union and other groups.

Dubbed "Wake Up, Poland," the protest is an expression of the deep anxieties gripping many Poles as the government tries to lower state debt by embracing pro-market reforms that are weakening the social safety net.

Many of the protesters are also conservative Catholics ill at ease in a country that is quickly growing more secular as it grows wealthier and more integrated with the West.

A key source of anger for the protesters is a new law put through by the pro-market government of Prime Minister Donald Tusk which will gradually raise the retirement age to 67 for all Poles from 60 for women and 65 for men.

Participants also expressed anger at a decision by the Polish national broadcasting council to strip a Catholic TV station, TV Trwam, of a free digital TV signal. They argue that it marks a blow to freedom of expression and an attempt to silence their conservative and Catholic world view. The broadcasting council, however, has said the station lost its transmission rights because of a lack of transparency in its funding.

Protesters sang patriotic and religious songs as they gathered at Three Crosses Square in downtown Warsaw, some of them holding rosaries.

"Our presence here is a sign of opposition to the discrimination against Catholic media and TV Trwam," Zbigniew Ziobro, a leading conservative politician, told protesters, according to the news agency PAP.

Police had no estimate yet for the number of protesters, but private broadcaster TVN24 said tens of thousands turned out.

US court rules Motorola can't enforce German injunction against Microsoft, keeps the Xbox 360s flowing

In another face of the ever turning world of patent battles, Reuters reports Microsoft has snagged a victory over Motorola as the 9th US Circuit Court of Appeals ruled in its favor today. Motorola had obtained an injunction in Germany against Microsoft products -- including the Xbox 360 and Windows 7 -- based on its h.264 patents back in May, but today the court upheld a previous decision putting enforcement on hold because of Microsoft's existing lawsuit against Moto for breach of contract. Microsoft's push to leverage its patents into licensing payouts from manufacturers of Android devices have seen the two at each other's throats since at least 2010, when the folks from Redmond lodged an ITC complaint over nine patents and followed up with another suit accusing Motorola of charging unfair license fees for its patents. Motorola fired back with its own pair of lawsuits -- all of this a year before we heard it would be acquired by Google -- and the battle was on. Whether or not this moves us any closer to any resolution remains to be seen, but at least Bavarian gaming consoles are safe, for now.

Sandra Fluke sparks debate - News - Daily Campus - Southern ...

The Women?s and Gender Studies Program hosted ?Economics and Equality: How Obstacles to Women?s Health Care Can Affect Us All? at SMU. Journalism professor Karen Thomas moderated the panel symposium featuring Sandra Fluke Monday night.

Charles E. Curran, SMU?s Elizabeth Scurlock University Professor of Human Values, associate provost and Dedman Law School professor Linda Eads and Ken Lambrecht, president and chief executive officer of Planned Parenthood North Texas, sat on the discussion panel.

?I?d like to begin with a caveat: if you?ve come to see how slutty I am in person, you are probably going to be disappointed with the content of my discussion,? Fluke at the start of her speech, referring to the Rush Limbaugh controversy that first thrust her into the spotlight, said.

After responding to ?misconceptions? regarding her remarks to the Democratic members of the House in February, Fluke recognized that limiting women?s access to affordable contraceptives deprives a very specific group of women of their rights to health care.

She said giving insurers the choice to cover the cost of contraceptives or not is ?an incredible personal choice to hand over to your employer.?

Eads framed her discussion of women?s health and legislation with regards to constitutional law, stating that the issue could be discussed in terms of constitutional privacy and freedom of religion.

?Government cannot control our procreation. Is there anything more an anathema to a human being than to have the government, to have politicians, control procreation?? Eads said.

Curran called a proposed compromise ?brilliant in many ways.? The new legislation would allow the government to step in and offset the high costs of contraceptives when a woman?s place of employment or other nonprofit agency offering her insurance coverage is opposed to contraceptives.

?No compromise is perfect, but let?s face it ? the whole political spectrum today, both left and right, is unwilling to compromise,? Curran said.

Lambrecht closed the panel by highlighting the importance of women?s health centers like Planned Parenthood. Legislation, like Title 10, has stripped $75 million from the Texas state budget and led to the closure of 60 Planned Parenthood centers.

Despite the reduced budget, Lambrecht said there has actually been an increase in government and taxpayer spending on women?s care.

Thomas and audience members followed up his comment with many questions. The questions posed covered abortion, global women?s health care, social movements, political agenda setting and family planning. The conversation greatly impressed SMU Student Senate Vice President Zane Cavender.

?Regardless of personal beliefs or ideals, it is phenomenal that SMU could host this event,? Cavendar said.

?It truly demonstrates the caliber of our university and its student body.?

Fluke ended the program by thanking the audience for attending and a challenge for future conversation.

?Respect and honor each other?s choices,? she said. ?No matter one?s personal views.??

(AP) ? For many Americans, particularly those on the older ? OK, squarer ? side of the generation gap, Andy Williams was part of the soundtrack of the 1960s and '70s, with easy-listening hits like "Moon River," the "Love Story" theme and "The Most Wonderful Time of the Year" from his beloved Christmas TV specials.

The singer known for his wholesome, middle-America appeal was the antithesis of the counterculture that produced rock and roll.

"The old cliche says that if you can remember the 1960s, you weren't there," Williams once recalled. "Well, I was there all right, but my memory of them is blurred ? not by any drugs I took but by the relentless pace of the schedule I set myself."

The entertainer, who died Tuesday night at his Branson home following a yearlong battle with bladder cancer, had a plaintive tenor, boyish features and clean-cut demeanor that helped him outlast many of the decade's rock stars and fellow crooners such as Frank Sinatra and Perry Como. He remained on the charts into the 1970s and continued to perform into his 80s.

Williams became a major star in 1956, the same year as Elvis Presley, with the Sinatra-like swing number "Canadian Sunset." For a time, he was pushed into such Presley imitations as "Lips of Wine" and the No. 1 smash "Butterfly."

But he mostly stuck to what he called his "natural style" and kept it up throughout his career. In 1970, when even Sinatra had temporarily retired, Williams was in the top 10 with the theme from "Love Story," the Oscar-winning tearjerker. He had 18 gold records, three platinum and five Grammy award nominations.

Williams was also the first host of the live Grammy awards telecast and hosted the show for seven consecutive years, beginning in 1971.

Movie songs became a specialty, including his signature "Moon River." The longing Johnny Mercer-Henry Mancini ballad was his most famous song, even though he never released it as a single because his record company feared such lines as "my huckleberry friend" were too confusing and old-fashioned for teens.

The song was first performed by Audrey Hepburn in the cherished 1961 film "Breakfast at Tiffany's," but Mancini thought "Moon River" ideal for Williams, who recorded it in "pretty much one take" and also sang it at the 1962 Academy Awards. Although "Moon River" was covered by countless artists and became a hit single for Jerry Butler, Williams made the song his personal brand. In fact, he insisted on it.

"When I hear anybody else sing it, it's all I can to do stop myself from shouting at the television screen, 'No! That's my song!'" Williams wrote in his 2009 memoir titled, fittingly, "Moon River and Me."

"The Andy Williams Show," which lasted in various formats through the 1960s and into 1971, won three Emmys and featured Williams alternately performing his stable of hits and bantering with guest stars.

It was on that show that Williams ? who launched his own career as part of an all-brother quartet ? introduced the world to another clean-cut act ? the original four singing Osmond Brothers of Utah. Four decades later, the Osmonds and Williams would find themselves in close proximity again, sharing Williams' Moon River Theater in Branson.

Williams did book some rock and soul acts, including the Beach Boys, the Temptations and Smokey Robinson. On one show, in 1970, Williams sang "Heaven Help Us All" with Ray Charles, Mama Cass and a then-little known Elton John, a vision to Williams in his rhinestone glasses and black cape. But Williams liked him and his breakthrough hit "Your Song" enough to record it himself.

Williams' act was, apparently, not an act. The singer's unflappable manner on television and in concert was mirrored offstage.

"I guess I've never really been aggressive, although almost everybody else in show business fights and gouges and knees to get where they want to be," he once said. "My trouble is, I'm not constructed temperamentally along those lines."

His wholesome image endured one jarring interlude.

In 1976, his ex-wife, former Las Vegas showgirl Claudine Longet, shot and killed her lover, skiing champion Spider Sabich. The Rolling Stones mocked the tragedy in "Claudine," a song so pitiless that it wasn't released until decades later. Longet, who said the slaying was an accident, spent only a week in jail. Williams stood by her. He escorted her to the courthouse, testified on her behalf and provided support for her and their children, Noelle, Christian and Robert.

Also in the 1970s, Williams was seen frequently in the company of Ethel Kennedy, Robert Kennedy's widow. The singer denied any romantic involvement.

He was born Howard Andrew Williams in Wall Lake, Iowa, on Dec. 3, 1927, and began performing with older brothers Dick, Bob and Don in the local Presbyterian church choir. Their father, postal worker and insurance man Jay Emerson Williams, was the choirmaster and the force behind his children's career.

When Andy was 8, Williams' father arranged for the kids to have an audition on Des Moines radio station WHO's Iowa Barn Dance. They were initially turned down but kept returning until they were finally accepted. The show attracted attention from Chicago, Cincinnati and Hollywood. Another star at WHO was a young sportscaster named Ronald Reagan, who would later praise Williams as a "national treasure."

The brothers later worked with Kay Thompson, a singer who eventually became famous for the "Eloise" children's books. She had taken a position as vocal coach at MGM studios, working with Judy Garland, June Allyson and others. After three months of training, Thompson and the Williams Brothers broke in their show at the El Rancho Room in Las Vegas, drawing rave reviews in New York, Los Angeles and across the nation and as much as $25,000 a week.

After five years, the three older brothers, who were starting their own families, had tired of the constant travel and left to pursue other careers.

Williams initially struggled as a solo act and was so broke at one point that he resorted to eating food intended for his two dogs.

A two-year TV stint on Steve Allen's "Tonight Show" and a contract with Cadence Records turned things around. Williams later formed his own label, Barnaby Records, which released music by the Everly Brothers, Ray Stevens and Jimmy Buffett.

Williams was a lifelong Republican who once accused President Obama of "following Marxist theory." But he acknowledged experimenting with LSD, opposed the Nixon administration's efforts in the 1970s to deport John Lennon and in 1968 was an energetic supporter of Robert Kennedy's presidential campaign. When Kennedy was assassinated in Los Angeles in June 1968, just after winning the California Democratic primary, Williams sang "The Battle Hymn of the Republic" at his funeral.

"We chose that song because he used it on the campaign trail," Williams later said of Kennedy, who had been a close friend. "He had a terrible voice, but he loved to sing that song. The only way I got through singing in church that day was by saying, 'This is my job. I can't let emotion get in the way of the song.' I really concentrated on not thinking about him."

After giving up touring, he settled in Branson, with its dozens of theaters featuring live music, comedy and magic acts, and was among the first wave of national entertainers to perform there regularly.

When he arrived in 1992, the town was dominated by country music, but Williams changed that with his classy, $13 million theater in the heart of the entertainment district, where he did two shows a night, six days a week, nine months of the year. Only in recent years did he cut back to one show a night. His most popular time was Christmas.

Not everyone in Hollywood accepted his move to the Midwest. "The fact is most of my friends in L.A. still think I'm nuts for coming here," he told The Associated Press in 1998.

He and his second wife, the former Debbie Haas, divided their time between homes in Branson and Palm Springs, where he spent his leisure hours on the golf course when Branson's theaters were dark during the winter months following Christmas.

Retirement was not on his schedule. As he told the AP in 2001: "I'll keep going until I get to the point where I can't get out on stage."

Williams is survived by his wife and his three children.

(AP) ? Myo Myint lost most of his right arm and right leg and several fingers fighting for the Burma army before he began working against Myanmar's military rulers and became a political prisoner.

The 49-year-old political refugee would like to return to his homeland one day, but he doesn't believe it will happen, even after hearing Myanmar opposition leader Aung San Suu Kyi say she would work to make sure people like him could come back.

Myint was among thousands of elated supporters who greeted Suu Kyi with cheers, tears and a standing ovation Tuesday as she took to the stage at the Allen County War Memorial Coliseum in Fort Wayne, Ind., the fourth stop on her 17-day U.S. tour.

Like Suu Kyi, Myint was imprisoned in 1989. But Myint, who spent 15 years as a political prisoner, said he doesn't believe Suu Kyi will be able to help him go back to Myanmar. That's because he says he's too well-known for working against the junta, having been featured in an HBO documentary called "Burma Soldier."

"She cannot do anything. She is not in the power," he said.

Sixty-seven-year-old Suu Kyi, who was recently elected to parliament after spending 15 years under house arrest for opposing Myanmar's military rulers, voiced optimism for democracy in her Southeast Asian home.

"The important thing is to learn how to resolve problems. How to face them and how to find the right answers through discussion and debate," the Nobel Laureate told the more than 5,000 people who gathered to hear her speak. Fort Wayne is home to one of the largest Burmese communities in the United States.

Myint said he lost his arm and leg in a battle with communist insurgents while serving in the Burma army. After he left the army, he switched sides, meeting with resistance groups and working against the military rulers.

"We were looking together to find a way to end the civil war," he said.

Suu Kyi rose to prominence during a failed pro-democracy uprising to protest Burma's military-backed regime in 1988. Thousands of the 1988 protesters were killed and tens of thousands more ? including Oxford-educated Suu Kyi ? spent years as political prisoners. Suu Kyi's National League for Democracy party was subsequently stymied by the junta's iron grip on the country.

But Suu Kyi voiced cautious hope Tuesday.

"The differences and problems we have amongst ourselves, I think we can join hands and reconcile and move forward and solve any problems," she said. Suu Kyi delivered most of her speech ? and answered most questions ? in Burmese, with an English translation by video.

Since 1991, when a single Burmese refugee resettled in Fort Wayne ? about two hours north of Indianapolis and 8,000 miles from Myanmar ? thousands more have followed, many of them relocating under a federal program after years in refugee camps in Thailand.

After his imprisonment, Myint spent three years in Thailand before applying to become a political refugee. A brother who had fought against the Burma military rulers in 1988 already lived to Fort Wayne.

Both were excited to attend Suu Kyi's speech Tuesday. Though Myint doesn't believe he will ever be able to return, he was pleased to hear her say she would work to clear the way for the return of those who left.

"I would love to go back but I have no chance," he said.

For some Burmese residents, Suu Kyi's visit was the first tangible connection with the homeland they hope to one day return.

"I would appreciate and be very grateful if you could look back to your home country, which is Burma," she said.

Myanmar's half century of military rule invited crippling international sanctions. But President Thein Sein, who is visiting New York this week, has introduced political and economic reforms in recent years, and the U.S. is considering easing the main plank of its remaining sanctions, a ban on imports.

Suu Kyi, who already has met with President Barack Obama and received Congress' highest honor, said the sanctions were effective in pushing the junta to reform but that "they should now be lifted" so Myanmar can rebuild its economy.

"We cannot only depend on external support and support of our friends from other nations. We should also depend on ourselves to reach this goal," she said.

Researchers develop editing toolkit for customizing zebrafish genomes

ScienceDaily (Sep. 23, 2012) ? Mayo Clinic researchers and an international team of scientists have developed a highly-efficient means of editing zebrafish genomes for research purposes, eliminating a bottleneck that has stymied biomedical scientists from using the fish as a model for human disease.

The details appear online today in the journal Nature.

For many researchers, zebrafish are becoming the model of choice for genetic studies. However, the inability to efficiently target genetic modifications has delayed their use by some. The Mayo team used an improved variant of artificial transcription activator-like effector nucleases, or TALENs, to provide a new approach.

"By using genetic engineering tools called TALENs and synthetic DNA to make defined changes in the genomes of our fish, we are able to make small changes (just a few nucleotides) as well as add a specific sequence for biological gene switch applications," says Stephen Ekker, Ph.D., senior author and head of Mayo's zebrafish core facility. "This is the first time we've been able to make custom changes to the zebrafish genome."

Dr. Ekker says this toolkit opens the door to a range of new experiments in zebrafish, including modeling of human disease by introducing small point mutations, designing regulated gene alleles, and developing classical structure/function experiments using an animal model system.

This new approach has implications for other model systems, including mice, rats, flies and worms, and possible applications in stem cell research.

"To our knowledge, this TALEN toolkit also is the most active described to date," says Dr. Ekker. "This has important implications for the growing TALEN field, whether used in fish or any other cells. We used this higher activity for genome editing applications. We also used it to conduct a series of somatic gene function assessments, opening the door to an array of non-germline experiments in zebrafish."

Florida's jobs report undermines official optimism

TALLAHASSEE, Florida (Reuters) - Florida's unemployment rate held at 8.8 percent for a second consecutive month in August, authorities said on Friday, in a report dealing a new blow to Republican Governor Rick Scott.

Scott, who has spent the past several months touting his state's economic recovery, highlighted the 28,000 new jobs created in August. Florida's jobless level, however, continues to lag behind the rest of the nation which saw the unemployment rate in August fall to 8.1 percent from 8.3 percent in July.

"This increase in new jobs is proving that the decisions we're making here in Florida are pointing our state in the right direction," Scott said in a statement.

The governor's oft repeated claim that Florida is leading the nation in job growth is being challenged by data that indicates Florida's recovery is far from seamless.

Susan MacManus, a political science professor at the University of South Florida, says Scott and President Barack Obama both made bold promises during their campaigns that may be hard to deliver.

"They both may have painted themselves into a corner," MacManus said.

The state's unemployment rate, until recent months, had been dropping faster than the national average. Other indicators tell another story about the state's jobs market.

Last month the Legislature's Office of Economic and Demographic Research released an analysis that attributed a large portion of Florida's falling unemployment rate - about 70 percent - to a reduction in the labor force and not to people getting back to work.

A recent study by Florida International University reported that Florida led the nation in the number of long-term unemployed in 2011, with more than half of jobless workers still looking for work after six months compared to just under 44 percent nationwide.

Such economic dissonance spilled over earlier this week as Scott bristled when pressed on the numbers by reporters, cutting off a series of questions on the apparent disconnect between his message and the less encouraging economic indicators.

Scott campaigned for office in 2010 almost exclusively on economic development, and calls himself the "Jobs Governor".

He pledged to create 700,000 private sector jobs in Florida over seven years, in addition to the estimated 1 million new jobs that were expected to be created "naturally" by population growth.

That earlier promise was redefined shortly after Scott took office, with the governor saying the 700,000 goal included all jobs. Asked this week if he would make that goal, Scott was unequivocal.

"Absolutely, no question," Scott said.

Hi hopes of reducing the unemployment rate have been thwarted in part due to Scott's own effort to shrink the state bureaucracy. Government employment fell by 5,300 in August.

Other newly released data paint a bleak picture. On Thursday, the U.S. Census Bureau released a report that median income in Florida dropped 2.9 percent in 2011. The state's median income fell to $44,299 in 2011 from $45,609 in 2010, according the Census' American Community Survey. The national median income was $50,502.

The survey also found that 17.3 percent - about one-in-six - Floridians were living below the poverty level, about $23,000 for a family of four. That's up from 16.5 percent in 2010. National poverty rates also went up. Both state and national rates have climbed for the past four years.
